1. Agreement
These Terms govern access to getknown.ai marketing sites, demos, and paid services (“Service”) provided by Known Consulting (Pty) Ltd (“Known”, “we”). By using the Service you agree to these Terms. If you use the Service for a company, you confirm you can bind that company.
2. The Service
getknown provides software tools to create and host AI website assistants configured from business website content, including lead capture features, optional embedding, billing, and related product interfaces. Features vary by plan as described on our pricing page at the time of purchase.
We may offer private demos before purchase. Demos are not a public directory of businesses.
3. Accounts and eligibility
- You must provide accurate business and contact information.
- You must be able to form a binding contract under South African law.
- You are responsible for credentials and for activity under your account.
4. Customer content and responsibilities
You retain rights to your content. You grant us a licence to host and process your content solely to provide and improve the Service.
You are responsible for:
- The accuracy of your website and configuration
- How you use leads collected via the assistant
- Compliance with laws that apply to your industry and marketing (including POPIA where you are a responsible party)
- Not using the Service for unlawful, harmful, or abusive purposes
The assistant can be wrong. It is not a substitute for licensed professional advice. You must not present it as a human where that would mislead in a regulated context without appropriate disclosure and handoff.
5. Acceptable use
You may not:
- Break or probe the Service except with our written permission
- Resell the Service as a white-label platform without a separate agreement
- Upload unlawful content or infringe others’ rights
- Use the Service to spam, phish, or harass
- Bypass usage limits or payment
6. Plans, fees, and taxes
Paid plans are billed in South African Rand (ZAR) via Paystack or another processor we nominate. Current list prices appear on getknown.ai. We may change prices with notice for the next billing period.
Fees are exclusive or inclusive of VAT as stated at checkout or on the invoice. Invoices are issued by Known Consulting (Pty) Ltd where applicable.
Once-off services (for example white-glove install) are charged separately.
7. Free demos and beta features
Demos and beta features are provided “as is”, may change, and may be withdrawn. They may use operational defaults different from production entitlements.
8. Intellectual property
We and our licensors own the Service software, brand, and documentation. You own your content. Feedback you give may be used to improve the Service without obligation to you.
9. Privacy
Our Privacy Policy explains how we process personal information.
10. Confidentiality
Each party should protect the other’s non-public information shared for the Service with reasonable care, except information that is public, independently developed, or required to be disclosed by law.
11. Suspension and termination
You may stop using the Service and cancel renewal under the Refunds policy. We may suspend or terminate access for non-payment, abuse, legal risk, or material breach. On termination, your right to use the Service ends. Sections that should survive (fees owed, IP, liability limits, indemnity) survive.
12. Warranties and disclaimers
We provide the Service with reasonable skill and care. Except as required by law that cannot be excluded, the Service is otherwise provided “as is” without warranties of uninterrupted operation, perfect accuracy of model outputs, or fitness for a particular purpose.
13. Liability
To the maximum extent permitted by South African law:
- We are not liable for indirect or consequential loss, lost profits, or lost data
- Our total liability arising out of the Service in any 12-month period is limited to the fees you paid us for the Service in that period
Nothing in these Terms limits liability that cannot be limited by law (including fraud or gross negligence where such limit is unenforceable).
14. Indemnity
You will defend and indemnify Known against third-party claims arising from your content, your use of leads, your breach of these Terms, or your violation of law — except to the extent caused by our wilful misconduct.
15. Changes
We may update these Terms. Continued use after the effective date constitutes acceptance of material updates notified on this page or by email for existing customers where appropriate.
16. General
These Terms are governed by the laws of the Republic of South Africa. Courts of South Africa have jurisdiction. If a clause is unenforceable, the rest remains. These Terms are the whole agreement for the Service unless a signed order form says otherwise.
